Terms and Conditions
The following terms and conditions (“booking conditions’) form the basis of your contract with Global Tours (Global Tours, ’we’ or ‘our’). Please read them carefully as they set out your and our respective rights and obligations. By asking us to confirm your booking, we are entitled to assume that you have had the opportunity to read and have read these booking conditions, that you agree to them and that you agree to them applying to your holiday arrangements that you book with us and which we agree to make, provide or perform (as applicable) as part of our contract with you.
BOOKING CONDITIONS ~ Important Note The travel industry in Myanmar is developing at a phenomenally rate. Myanmar has a newfound appeal for many visitors. It is important to recognize that the level of services and standards in some areas, whilst improving, are not yet comparable to established Western travel destinations. Group travel is a shared experience and it is important to have a sense of humor, along with a positive attitude towards your fellow Travelers and hosts and an acceptance of the realities of travel in developing countries
RESERVATIONS & DEPOSITS ~ A non-refundable deposit is required upon confirmation of your booking. Once a deposit is received it will be understood that you have read and accept the Terms and Conditions. The Booking Form must be completed and signed by you and accompanied by the non-refundable deposit of $ 500.00 per person. Should the deposit not be received within 7 days of your booking confirmation, any reservations already made in respect of the holiday will be automatically cancelled.
BALANCE ~ the balance is due 60 days prior to departure. Failure to pay in full by the due date may result in the automatic cancellation of your booking. If you are booking within 60 days prior to departure, full payment is due immediately. All prices are quoted in Australian dollars and must be paid in Australian dollars.
CANCELLATION & REFUNDS ~ Cancellation must be received in writing and will be subject to the following cancellation fees applied per person:
- More than 60 days before departure – loss of non-refundable deposit.
- Less than 60 days before departure -25%
- Less than 45 days before departure – 50%.
- Less than 30 days before departure -100%.
Refunds will not be given for unused or cancelled services after your tour arrangements have commenced.
VALIDITY ~ the information is valid at the time of publication but is subject to change. Prices are based on tariffs and exchange rates, at the time of printing, and are quoted in Australian Dollars. Global Tours reserves the right to change the price and itinerary without notice. In the event of currency fluctuations, service providers’ tariffs, fuel prices, accommodation rates and other holiday components, Global Tours reserves the right to adjust prices anytime, up to an including the date of departure, even after receipt of the balance of payment from the client. Acceptance of this arrangement is an express condition of making a reservation. Any alteration to advertised prices would be brought to your attention.
TRAVEL DOCUMENTS ~ Passengers travelling to Myanmar must be in possession of a passport with at least 6 months validity and the necessary visa, health certificates at the time of commencement of travel. All such documents are the sole responsibility of the client. Global Tours will assist, on request, in organising the necessary visa. Global Tours accepts no responsibility or liability whatsoever for the failure of clients to obtain the appropriate documentation.
GENERAL~ These Booking Conditions are governed by the laws applicable in the State of South Australia, and the parties agree to submit to the exclusive jurisdiction of the courts of South Australia. If part or all of any provision of these Booking Conditions is illegal or unenforceable, it will be severed from these Booking Conditions and will not affect the continued operation of the remaining provisions of these Booking Conditions. We may vary these Booking Conditions from time to time by notifying you in writing.
RESPONSIBILITIES ~ Global Tours is acting as an agent only for the persons and local touring companies who provide and conduct its tours, offering the means of transport, accommodation and other tourist services. To the best of Global Tours knowledge, these companies are licensed to offer these services. All receipts, tickets, vouchers and coupons are issued subject to the terms and conditions under which transportation and services are offered. Each service provider is responsible for the part of the tour it conducts. Service providers are not our agents or employees and are not under our direct control. We therefore do not warrant the performance of any service provider. We do not accept, and you release us from, all liability for any injury, loss, damage, costs or expenses, including without limitation any property damage or personal injury, that you may suffer which arises out of any act or omission of a service provider or operator who provides services in connection with your tour. Any claim that you may have in relation to a service provider should be raised directly with that service provider. Some suppliers and providers limit their liability and are often subject to international convention between countries.
In Myanmar there is always the possibility that local circumstances beyond the control of Global Tours may call for some changes to your itinerary, even after its commencement and that any increases in cost will be charged to the client. Your ability to be open minded, flexible, patient and show some tolerance, under these circumstances will make your holiday a memorable experience.
The client hereby agrees that any liability on the part of Global Tours is limited to a maximum of the tour cost, subject to these conditions: It is accepted by the client that Global Tours is not liable for a ‘Force Majeure Event’ meaning any event which Global Tours could not, even with all due care, foresee or avoid such as any accident, sickness, injury, death, damage, loss, delay or detention due to any conduct of these third parties, or any unforeseen circumstances outside the control of Global Tours, including without limitation, civil strife, acts of terrorism, riots, war or threat of war, political instability, malicious damage, sabotage, fire, flood, drought, weather conditions, natural disaster, industrial disputes, hotel overbooking, technical faults with transportation and road conditions or infrastructure failures or reasonable apprehension of the foregoing cancellation, curtailment or rescheduling of flights. You acknowledge and agree that there are inherent risks involved in participating in the tour, including without limitation possible contact with native fauna, local residents, unforeseen events and travel in remote locations. By making a booking, you agree to accept all risks associated with the tour. Global Tours will do everything possible to ensure the departure of your selected tour date but must reserve its rights upon the occurrence of a “Force Majeure Event”.
HEALTH & FITNESS ~ A minimum level of fitness is required to be able to participate on our Tour. As a minimum you will need to be able to walk 2km on uneven surfaces, carry your own luggage and walk up a few flights of stairs with ease. You must inform us at the time of booking of any medical condition that you have which may affect your ability to participate in the tour.
We may decide at our absolute discretion not to include you in a tour or in any activity if we consider that you are unable to safely participate in that tour or activity as a result of a medical condition or otherwise, or if we consider that your participation may place the safety of other clients at risk. We exclude all liability for any illness, injury or death sustained by you on tour as a result of any pre-existing medical condition. We will not be responsible for, and you agree to release us from, any liability arising out of any medical condition, illness or injury that you may suffer during the tour or as a result of the tour. You should consult your doctor or travel medical specialists in your home state before travel regarding any inoculations, medications and other health precautions that should be taken in relation to travel within the regions comprising your tour.
TRAVEL INSURANCE ~Travel insurance is not included in your tour cost. It is a condition of travelling with Global Tours and for your protection that you have comprehensive travel insurance to cover you for the full duration of your journey for costs associated with illness, injury, death, loss of or damage to baggage and personal items, cancellation, loss of deposit, medical and hospitalisation expenses, repatriation and curtailment expenses due to illness, the need to return home unexpectedly, evacuation expenses and accidental death or disability. You are solely responsible for obtaining the appropriate insurance cover.
GROUP TOURS ~ quoted holiday prices for group tour packages are based on a minimum number of people traveling together and staying in twin share accommodation. Should the minimum number of persons not be attained, Global Tours reserves the right to cancel, amend or re-cost the tour 45 days prior to departure. If such an event occurs, a client may continue the tour as amended and a surcharge to recover the costs of still operating the tour, below the minimum number, will apply. Should these options be unacceptable, alternative dates will be made available or a full refund offered.
SINGLE SUPPLEMENT ~ For Group tours only. Single travellers who are wiling to share accommodation with another tour member must advise Global Tours at the time of reservation. Although every effort will be made to comply with requests regarding age, non-smoking etc… this is not always possible and we accept no responsibility for any incompatibility between persons sharing twin/triple rooms.
No guarantee is given that a share room will be found. In the event, we cannot match you with another member and a single room is taken, the single supplement as quoted will apply and is due at the time of balance payment. If you prefer a single room then the single supplement applies.
NOT INCLUDED ~ Rates do not include items of a personal nature such as phone calls, laundry, mini-bar consumption and room service. Tipping is not mandatory but it is expected and enormously appreciated in cities and tourist sites. Gratuities to guides, drivers and porters are at your discretion. Please note that in some rural areas where tipping is not the norm, a generous tip could cause some embarrassment to the recipient.
TOUR LEADERS AND LOCAL GUIDES ~ one of the highlights of travelling will be your interaction with the people of the country that you are visiting and the members of your group. Such interaction should be based on respect for the culture, rights and opinions of others. The Tour Leader, Local Guide or Management of Global Tours reserves the right to terminate the provision of services to passengers deemed to be behaving in a manner, which might cause serious offence, be in breach of the law, threaten the safety or significantly compromise the enjoyment of fellow travellers.
All possible care is taken to ensure suppliers maintain high standards. However, as we do not control the airlines, car operators or hotels, we cannot be responsible in any way for problems resulting from the booking, howsoever arising, unless it is a direct result of negligence on our part or the part of our employees.
